Courts Wary of ‘Double Commission’ Payment

Yet another case on the fees payable to estate agents will cause them concern and vendors of properties to breath a sigh of relief.
 
An estate agent sought a commission under an agreement with a vendor, despite the fact that the agent had not bBuilding 2rought about the sale of the property.
 
Although each case will be decided on its own merits, and the wording of the legal agreement between the vendor and the agent will be a crucial consideration, it is clear that the courts are keen to avoid a situation in which a vendor is bound to pay a sales commission to more than one agent.
