Lawyers have achieved a 70 per cent liability settlement for a 20-year-old man diagnosed with acute brain damage soon after his birth at Basildon Hospital in 1991
David Fawdrey's legal team claimed that negligent delays in his delivery had resulted in oxygen starvation and lifelong disabilities.
Mrs Justice Thirlwall approved the compromise on the liability issue. The damages will now go on to be assessed, but the court heard that Mr Fawdrey's compensation package will be worth 'several millions', to cover the costs of his future care.
After the hearing, Mr Fawdrey's parents commented, "We are relieved that the liability aspect of the case has concluded and that, once he receives his final settlement award, David will be able to fund the support and care that he will need for the rest of his life to maximise his independence.
"However, no amount of money will make up for the impact of his injuries on him and our family."
